Understand and agree that participating in the Event/Activity may expose the Minor to the risk of personal injury, death, communicable diseases, illnesses, viruses, or bodily condition or property damage caused by the direct or indirect transmission by any means of or exposure to an INFECTIOUS AGENT including, but not limited to, those arising out of coronavirus (COVID-19), severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), and any mutations arising from or relating there to. Infectious agent – means any bacteria, virus, toxin, parasite, organism, microorganism, or biological entity capable of causing a COMMUNICABLE DISEASE or exacerbating or accelerating an existing bodily condition or illness. I hereby acknowledge that I am voluntarily granting the Minor permission to participate in this Event/Activity and agree to assume any such risks. 2. Hereby release, discharge and agree not to sue 40 Love Foundation and/or City of Inglewood for any injury, death or damage to or loss of personal property arising out of, or in connection with, the Minor’s participation in the Event/Activity from whatever cause, including the active or passive negligence of 40 Love Foundation and/or City of Inglewood or any other participants in the Event/Class. The parties to this AGREEMENT understand that this document is not intended to release any party from any act or omission of “gross negligence,” as that term is used in applicable case law and/or statutory provision. 3. Assume any and all risks of personal injuries to the Minor and authorize 40 Love Foundation and City of Inglewood to contact or employ a licensed physician to render any medical treatment that may be deemed necessary for the Minor or to take and admit the Minor to any hospital. 4. Covenant not to sue or present any claim for personal injury including but not limited to wrongful death, or property damage, against 40 Love Foundation and/or City of Inglewood, agents or employees or volunteers for any accidents attributable to the Minor’s participation in the Event/Activity. 5. Warrant that the Minor is in good health and has no physical condition that would prevent the Minor from participation in the Event/Activity. 6. Agree that photographs, pictures, slides, movies, or videos of the Minor may be taken in connection with the Minor’s participation in the Event/Activity without compensation from the 40 Love Foundation and/or City of Inglewood and consent to the use of photographs, pictures, slides, movies, or videos for any legal purpose. 7. Acknowledge that 40 Love Foundation and/or City of Inglewood is not joint sponsors, partners, or otherwise jointly engaged in the above named Event/Activity. IMPORTANT: THIS DOCUMENT RELIEVES 40 LOVE FOUNDATION AND CITY OF INGLEWOOD AND OTHERS FROM LIABILITY FOR PERSONAL INJURY, WRONGFUL DEATH, AND PROPERTY DAMAGE RESULTING FROM THE MINOR’S PARTICIPATION IN THIS EVENT OR ACTIVITY. I HAVE READ THIS DOCUMENT, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN VOLUNTARILY. I declare under penalty of perjury under the laws of the State of California that I am the parent or legal guardian of Minor. I further declare that I shall indemnify and hold harmless the 40 Love Foundation and/or City of Inglewood from and against any and all Claims resulting from, incident to, or arising out of Minor’s participation in the Event/Activity, any and all risks assumed by Minor and me above, and/or the breach of any promises, covenants, and/or representations made by me herein and/or in the above Release.
